Terms and Conditions
These Terms and Conditions apply to all families accessing services provided by The Learning Nest Co Pty Ltd, including Work + Nest, Creche, and any parent onsite programs.
By booking, enrolling or attending any service, you agree to the following:
1. Bookings & Cancellations
- A minimum of 2 hours' notice is required to cancel a booked session.
- Cancellations made with at least 2 hours' notice will be credited to your account.
- Sessions cancelled within 2 hours of the booking time will be charged in full and no credit or refund will be issued.
- All cancellations must be made via email to info@thelearningnestco.com.
- Any session cancelled by The Learning Nest Co will be automatically credited to your account.
2. Refunds
- Refunds will only be issued where the account is in credit and not in arrears.
- All refunds are subject to a two-week processing period after all required refund documentation has been completed and submitted via email.
3. Fees & Payments
- All Creche session passes must be paid in advance at time of purchase via the website or EFTPOS in person.
- All casual or individually requested sessions must be paid prior to the session commencing via EFTPOS.
- A late collection fee of $1 per minute for the first 10 minutes, escalating to $5 per minute thereafter, will apply and be charged on the day.
- Any nappies or wipes supplied by the Service will incur a charge of $2.50 per nappy change, payable upon collection.
4. Debt Recovery
- Unpaid services exceeding two weeks past the due date will result in termination of services.
- Outstanding accounts will result in debt recovery procedures commencing.
- If referred to a third-party debt collector, the Service is not responsible for any recovery fees incurred.
5. Refusal of Service
The Learning Nest Co reserves the right to refuse or terminate service if:
- Fees remain unpaid beyond two weeks
- Harm or threats of harm occur toward any person
- Inappropriate behaviour is displayed
- WHS standards are breached
- Family Conduct standards are breached
6. First Aid & Medical Emergencies
- All educators hold current First Aid and CPR qualifications.
- In the event of a medical emergency, educators will call 000 and administer first aid as required.
- Parents/guardians will be contacted immediately following any incident or injury.
- An incident report will be completed and provided to the parent/guardian.
- The Service reserves the right to call an ambulance if deemed necessary, at the cost of the family.
7. Medication
- Medication will only be administered with written consent from the parent/guardian.
- All medication must be provided in its original packaging with the child's name and dosage clearly labelled.
- Prescription medication must have the pharmacy label attached with the child's name, dosage, and frequency.
- Educators will not administer the first dose of any medication.
- A medication record will be completed and signed by the administering educator.
8. Medical Conditions
- Parents/guardians must disclose all known medical conditions, allergies, and dietary requirements at enrolment.
- A medical management plan must be provided for any child with a diagnosed medical condition (e.g., anaphylaxis, asthma, epilepsy, diabetes).
- It is the responsibility of the parent/guardian to keep all medical information up to date.
9. Illness
- Children who are unwell must not attend the Service.
- If a child becomes unwell during a session, the parent/guardian will be contacted to collect the child immediately.
- Children must be symptom-free for at least 24 hours before returning to the Service, or as otherwise advised by a medical professional.
10. Supervision & Collection of Children
- Children must be signed in and out by a parent/guardian or authorised person at every session.
- Children will only be released to persons listed as authorised on the enrolment form.
- Photo identification may be requested from any person collecting a child.
- If no authorised person is available to collect the child, the Service will attempt to contact all listed emergency contacts. If the child remains uncollected, the Service may contact the relevant authorities.
11. Court Orders & Custody Arrangements
It is the responsibility of the enrolling parent/guardian to provide the Service with copies of any current court orders or custody arrangements. The Service will comply with any legal documentation provided.
12. Personal Property & Damages
- The Learning Nest Co is not responsible for any loss, theft, or damage to personal property brought to the Service.
- Any intentional damage to the Service's property or equipment caused by a child or family member may result in the cost of repair or replacement being charged to the family.
13. Photography & Videography
- Photographs and videos may be taken during sessions for documentation, social media, and marketing purposes.
- Written consent will be obtained from parents/guardians at enrolment.
- Parents/guardians may withdraw consent at any time by notifying the Service in writing.
14. Staff, Volunteers & Students
- All staff hold current Working with Vulnerable People (WWVP) checks.
- Volunteers and students may assist under the direct supervision of qualified educators.
- All staff, volunteers, and students are bound by the Service's Code of Conduct and Child Safe policies.
15. Staff Code of Conduct
All staff are required to adhere to the Service's Code of Conduct, which outlines expected professional and ethical behaviour. The Code of Conduct is available upon request.
16. Family Conduct
- All families and visitors are expected to behave respectfully toward staff, other families, and children at all times.
- Abusive, threatening, or inappropriate behaviour will not be tolerated and may result in termination of services.
- The Service reserves the right to request that any person leave the premises if their behaviour is deemed inappropriate.
17. Complaints
If you have a complaint or concern, please contact us at info@thelearningnestco.com. All complaints will be acknowledged and investigated in a timely manner in accordance with our Complaints Handling Policy.
18. Bathroom, Toileting & Hygiene
- Educators will assist children with toileting and hygiene as needed, maintaining dignity and respect at all times.
- Children who are not yet toilet trained must have an adequate supply of nappies, wipes, and spare clothing provided by the parent/guardian.
- If supplies are not provided, the Service will supply nappies and wipes at a charge of $2.50 per nappy change.
- All toileting and nappy changes will be documented.
- Children will be encouraged to wash their hands regularly throughout the session.
19. Food & Allergies
- Parents/guardians must provide all food and drinks for their child unless otherwise specified by the Service.
- All known allergies and dietary requirements must be disclosed at enrolment and kept up to date.
20. Sun Safety
- Sunscreen will be applied to children before outdoor play. Parents/guardians may provide their own sunscreen if preferred.
- Hats must be provided by the parent/guardian. Children without a hat will be restricted to shaded or indoor play areas.
21. Messy Play & Learning Experiences
- Children may participate in messy play activities including paint, clay, water, sand, and sensory materials.
- The Service recommends children attend in play-appropriate clothing.
- The Service is not responsible for any staining or damage to clothing.
22. Learning Resources
- All learning resources and equipment are provided by the Service.
- Children are welcome to bring a comfort item (e.g., dummy, blanket), but the Service is not responsible for any loss or damage.
23. Emergency Evacuation
- Emergency evacuation procedures are displayed throughout the Service.
- Regular evacuation drills are conducted in accordance with regulatory requirements.
- In the event of an emergency evacuation, parents/guardians will be contacted as soon as it is safe to do so.
24. Lockdown Procedures
- In the event of a lockdown, all persons on the premises will be directed to a secure area. Parents/guardians will be contacted as soon as it is safe to do so.
25. Agreement
By booking, enrolling or attending services, you confirm that you:
- Have read and understood these Terms and Conditions
- Agree to comply with them
- Are authorised to provide consent on behalf of your child/ren
